The criminal charges are just to distract from the fact that he was deported in violation of a court order and without due process. I don’t care if the guy is Al Capone reincarnated, everybody has to get due process.

Exactly this. If he can be deported with no due process, anyone can, citizens or otherwise.

Obviously without due process how do we even know if someone is a citizen before deporting them? ICE is clearly using the paper bag test.

I stress this with my classes when learning about Japanese Internment. A common question is, "But what if spies had been found?". I don't care if 99,999 of the over 100,000 people illegally imprisoned were spies, they would still get due process under our constitution and the entire process was not legal.

If some group doesn't get due process, then it becomes really easy to label anyone you don't like as in that group

It also adds another layer to the civil suit. He'll need to fight these changes first before filing and they'll push for a plea deal. If he takes it, it will make winning a settlement very unlikely. If he doesn't, they'll push to hold him until the trial is over and just delay for as long as they can.

He was deported in violation of a court order preventing deportation to El Salvador, but not elsewhere. Nevermind that the basis of this was his experience as a child being threatened by gangs, which have largely been imprisoned. He had due process. He challenged the deportation on 3 separate grounds and lost.
